1. Acceptance of Terms

Welcome to Koffie Connect. By accessing or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, please do not use our platform. Continuous use of our services constitutes your acceptance of these terms.

2. Description of Service

Koffie Connect provides API-based integration tools for eCommerce, scheduling, and messaging platforms. We facilitate data synchronization between third-party services like WooCommerce, Shopify, Callbell, and Google Calendar. Our services are offered as Software as a Service (SaaS) and are subject to the terms described herein.

3. Payments and Refunds

a) Payment Methods: We accept payments through Stripe, a third-party payment gateway. When processing payments, Stripe may collect your credit/debit card information according to their own privacy policy. We do not store your complete credit card data.

b) No-Refund Policy: Since our services are subscription-based digital products, all payments made are NON-REFUNDABLE. Once payment is processed and access is granted to the service, no refunds will be issued for any reason, including but not limited to:

  • Cancellations made after the current billing period
  • Dissatisfaction with the service after the billing period has started
  • Changes in the user's business needs
  • Errors in billing information provided by the user

c) Exceptions: We may consider refunds in cases of clearly attributable administrative errors on Koffie Connect's part, at our sole discretion. To request a review, you must contact us within 7 days after the charge.

4. Subscriptions and Billing

Subscriptions are billed recurring according to the selected plan. You authorize Koffie Connect to charge your payment method automatically each billing period. Prices may change with at least 30 days' notice before the next billing cycle.

To cancel your subscription, you must do so through your account before the next billing date. Cancellation does not generate a refund for the current period in use.

5. Data Security & Privacy

Your use of the service is also governed by our Privacy Policy. We implement high-standard security measures, including TLS/SSL encryption, secure hashed API tokens, and encrypted storage, to protect your API tokens and customer data. However, no data transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

6. Third-Party Services

Our platform integrates with third-party services (WooCommerce, Shopify, Callbell, Stripe, Google Calendar, among others). We are not responsible for the privacy practices, terms and conditions, or actions of these third-party services. We recommend reviewing the terms and privacy policies of each service you connect.

Koffie Connect does not control and is not responsible for the content, accuracy, expressed opinions, or practices of any third-party website or service linked from our platform.

7. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials and API tokens
  • All activities that occur under your account
  • Ensuring that your use of our services complies with all applicable laws and regulations
  • Protecting your customers' personal data according to applicable data protection laws (GDPR, CCPA, etc.)
  • Not using our services for any illegal purposes

8. Intellectual Property

All content, design, code, logos, and material on our platform are property of Koffie Connect or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9. Account Termination

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to violation of these terms. Upon termination, your right to use the service will cease immediately.

10. Limitation of Liability

Koffie Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use of data, or any other intangible loss, resulting from:

  • The use or inability to use the service
  • Costs of replacement of goods or services
  • Unauthorized access or alteration of your transmissions or data
  • Statements or conduct of any third party on the service
  • Service interruptions, errors, defects, omissions, or inaccuracies in any information

Our total liability shall not exceed in any case the amount paid by you in the 12 months preceding the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Koffie Connect and our directors, employees, agents, and affiliates, from any claim, liability, damage, loss, or expense, including reasonable legal fees, arising from or related to your use of the platform, your violation of these terms, or your violation of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will take effect 30 days after posting. Continued use of our services after the effective date of changes constitutes your acceptance of the new terms.

13. Governing Law

These terms shall be governed and interpreted in accordance with the laws of Ecuador, without effect on conflicts of law principles. Any dispute arising from these terms will be resolved in the competent courts of Ecuador.
